Terms of use
These terms cover this website, the free tools on it and the early access program. They are written to be read, so they are short and plain.
Draft for review by a lawyer before launch.

Who these terms are between
Inclusely is made by EVDEV, based in Toronto, Ontario, Canada. “We” and “us” mean EVDEV. “You” means the person using this site, and the business you represent if you use it for a business. By using the site or joining early access, you agree to these terms. If you do not agree, please do not use the site.
The Inclusely Shopify app is not released yet. When it is, it will have its own terms, which you will accept when you install it. Shopify's own terms also apply to anything you do in Shopify.
No guarantee of compliance, and not legal advice
A help tool, not a guarantee
Inclusely is a tool that helps you find and fix accessibility problems. It does not make your store compliant with the ADA, the AODA, the Accessible Canada Act, the European Accessibility Act, WCAG or any other law or standard, and it cannot promise that you will not receive a complaint, demand letter or lawsuit. Automated checks find only part of what WCAG covers, and some things can only be judged by a person.
We are not your lawyer
Nothing on this site, in our tools, reports or statements, or from our team is legal advice. We are not lawyers. Our guides explain laws in general terms. For advice about your business, speak with a lawyer. If you need a formal audit, hire a qualified accessibility auditor.
You stay responsible for your store
You decide what goes on your store and which changes to make, and you remain responsible for its accessibility and for meeting the laws that apply to you. Review any suggestion, generated text or code change before you use it. We are not responsible for legal outcomes, including complaints, claims, settlements, fines or judgments, whether or not you used Inclusely.
Using the free tools
You are welcome to use the free tools for your own stores and for clients. Please do not:
- scan or test websites you do not own or have permission to test;
- run automated or bulk requests, or try to get around rate limits;
- use the tools to harm, overload or break into any website, including ours;
- resell the tools or present their results as an official audit or certification;
- use the results to mislead anyone about a website's accessibility.
The tools are provided as they are. Results can be incomplete or wrong, and a passing result does not mean a page is accessible. We may change, limit or remove a tool at any time.
Early access
Joining early access is free and does not commit you to buy anything. We choose stores in the order and mix that helps us build the product, so we cannot promise everyone a place or a date. Any free scan or call we offer is to help you understand your store, and it is not a formal audit. Pricing shown on this site is planned launch pricing in US dollars and may change before the app is released. Paid plans will be billed through Shopify.
You can leave early access at any time by writing to [email protected]. We can end the program or your place in it at any time.
Our content and yours
The Inclusely name, logo, website, guides, tools and code belong to EVDEV or the people who license them to us. You may share links to our pages and quote short passages with credit. Please do not copy whole pages or tools, or use our name in a way that suggests we endorse you.
Text you create with our tools, such as a draft accessibility statement, is yours to use and edit. You are responsible for checking that it is accurate for your store before you publish it.
Shopify is a trademark of Shopify Inc. WCAG is published by the W3C. Inclusely is not affiliated with or endorsed by either.
Limits on our liability
We work hard to keep the site and tools accurate and available, but we cannot promise that they will always be correct, complete, secure or working. To the fullest extent the law allows:
- the site, the free tools and early access are provided as they are, without warranties of any kind, including warranties that they are fit for a particular purpose;
- we are not liable for indirect or consequential losses, such as lost profits, lost sales, legal costs, settlements, fines or damage to reputation, that come from using or relying on the site, the tools or any result they give;
- if we are found liable for anything related to the site, the free tools or early access, our total liability is limited to CA$100.
Some places do not allow some of these limits. Where that is the case, they apply only as far as the law permits, and nothing here limits rights you have that cannot be waived.
If someone makes a claim against us because you used the site or tools in breach of these terms, you agree to cover our reasonable costs of dealing with it.
Governing law, changes and contact
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario, unless the law where you live gives you the right to go to your local courts.
We may update these terms. When we do, we will change the date at the top. If you keep using the site after a change, the new terms apply. If any part of these terms cannot be enforced, the rest still applies.
